Lawyer-assisted Wills for Indian families

Sit down with a lawyer and decide who inherits what.

Making a Will is not about filling a form. It is about understanding what each clause means and how your assets can actually be divided. Our lawyers explain it in plain language, help you decide, and draft a Will that holds. In person, or over video.

If you died tonight, who would the law give your assets to?

Without a Will, the law splits it like this

Hindu Succession Act, 1956, Class I heirs

Indicative
With a Will: 100% goes exactly where you decide, in the proportions you choose, to the people you choose, with a guardian for your children and someone you trust in charge.

This is a simplified illustration of intestate succession for a common family situation. Real outcomes depend on the full list of surviving relatives, the type of property (self-acquired, ancestral, joint family), state amendments and case law. It is not legal advice. Talk to one of our lawyers before you act on it.

Three things most families get wrong

A nominee is not an heir.
A joint account is not a plan.

01

Nominee is not owner

A nominee is only a caretaker the bank or insurer can hand money to. Courts have repeatedly held the nominee must pass it on to the legal heirs. Naming a nominee settles nothing.

02

No Will means years, not weeks

Your family will need a court certificate to claim what you left. Fees are charged on the value of the estate, and the wait is commonly measured in years, not months.

03

Wording is where Wills fail

Most Wills that get challenged fail on how they were worded, not on whether they existed. That is exactly the part a lawyer sitting across from you is there to get right.

What we help with

Two kinds of Will. One careful conversation behind each.

Every Will begins with a lawyer walking you through your assets, your family and your choices, then drafting it for you and reviewing it line by line.

Single Will

For one person deciding how their own assets should pass, whether the estate is simple or has a few moving parts.

  • A lawyer explains each term in plain language
  • Guidance on how your assets can actually be divided
  • Full asset schedule, executor and guardian clauses
  • Draft prepared for you and reviewed by a lawyer
  • Clear signing and witness instructions

Joint or Mirror Will

For couples who want to protect each other and plan together, so that whichever spouse goes first, the plan still holds.

  • Everything in a Single Will, for both spouses
  • Matching mirror Wills, or a single joint Will
  • Guardian appointment for minor children
  • Survivorship and residuary clauses handled
  • One conversation covering the whole family

Four steps, start to signature

Guided the whole way. You are never left with a blank form.

STEP ONE

Book a consultation

Leave your number and pick a time. Meet a lawyer in person across Kerala, or over video wherever you are. No cost to talk it through first.

STEP TWO

Understand your choices

The lawyer walks you through your assets and family, explains what each option means, and helps you decide how everything should be divided. This is the part a form cannot do.

STEP THREE

We draft it for you

Your Will is drafted from that conversation and reviewed line by line for gaps, contradictions and anything that could invite a challenge later.

STEP FOUR

Sign with two witnesses

You receive the final Will and a one-page signing sheet. We tell you exactly where to sign, who can witness and what to avoid. Witnesses must not inherit under the Will.

About us

We do the one thing families keep putting off.

FamilyWill exists to make Will-making feel possible for an ordinary Indian family, not just for the wealthy with a family lawyer on call.

Most people avoid making a Will because they do not know what the terms mean or how their assets can be split fairly. So they wait, and the cost of waiting lands on the people they love. We fix that by putting a practising lawyer across the table from you, not a form on a screen, to explain, guide and draft.

We are part of the NexGrowth group of advisory brands, based in Kochi, Kerala, and we work with families across India and the Gulf. For high-value estates, trusts and business succession, our senior practice TrueLegacy takes over.

I kept putting it off for eleven years because I did not understand how to divide things fairly. The lawyer sat with us and explained everything. My wife did hers the same week.

I am in Dubai and my parents property is in Kochi. Over video they explained exactly which assets my Indian Will should cover and which it should not. Nobody had told me there was a difference.

After my father died without a Will, we spent two and a half years and a lot of money in court. I made mine the month it ended. I do not want my children doing that.

Questions we get every day
